1.1.1 These Terms of Service ("Terms") govern your use of the Protect Buddy website ("Website"), and all services provided by Millennial Financial Group Pty Ltd t/a Protect Buddy (ABN 27 620 214 888, ACN 620 214 888).

1.1.2 We are a Corporate Authorised Representative (CAR No. 1319120) of Nexa Life Solutions Pty Ltd (AFSL 563622) ("Licensee"). Our authorisation permits us to provide general advice in relation to life insurance products.

1.2 Acceptance of Terms

1.2.1 By accessing or using our Website, submitting any enquiry form, providing your details, or engaging with our services in any way, you agree to be bound by these Terms, our Privacy Policy, and any other notices displayed on our Website.

1.2.2 If you do not agree to these Terms, you must not use our Website or services.

1.2.3 We may update these Terms from time to time. The current version will always be available on our Website, and your continued use of our Website or services after any update constitutes your acceptance of the updated Terms.

1.2.4 These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts of appeal from them.

1.3 Who These Terms Apply To

1.3.1 These Terms apply to all users of our Website and services, including individuals, clients, prospects, and referral partners. Our services are intended for Australian residents and entities only.

1.3.2 Where we service clients who hold New Zealand citizenship or residency but are living in Australia and seeking Australian life insurance products, these Terms apply fully to those services.

1.3.3 We do not provide services to persons residing outside of Australia. By using our services, you represent that you are an Australian resident or are permanently residing in Australia.

2. Our Services

2.1 What We Provide

2.1.1 Protect Buddy provides general advice services in relation to life insurance, TPD insurance, trauma insurance, and income protection insurance.

2.1.2 We provide our services through our Website for initial enquiries and lead capture, telephone and video consultations, email communications, and in-person meetings where arranged.

2.1.3 We may in the future expand our services to include general insurance broking, claims management assistance, or other insurance-based advisory services. Any such expansion will be communicated to clients and may be subject to additional terms.

2.2 What We Do Not Provide

2.2.1 We do not provide personal financial advice. Our services are limited to general advice only and do not take into account your individual circumstances, objectives, financial situation, or needs.

2.2.2 We are not a financial planner, accountant, solicitor or tax adviser. Nothing on our Website or in our communications is legal, accounting or taxation advice.

2.2.3 We do not currently provide general insurance broking services such as home, car, or business insurance. Any future expansion into these services will be separately communicated.

2.3 Referral Partners

2.3.1 We receive referrals from third-party referral partners including, but not limited to, mortgage brokers, real estate agents, solicitors, financial advisers, and other professionals ("Referral Partners").

2.3.2 We may pay or receive referral fees or commissions in connection with some referrals. Where required by law, we will disclose the nature of any referral arrangement to you.

2.3.3 Referral Partners are independent of Protect Buddy. We are not responsible for advice, representations, or services provided by any Referral Partner, and their engagement with you is governed by their own terms and obligations.

2.3.4 We also receive word-of-mouth referrals from existing clients. We do not pay commissions or fees to clients for such referrals.

2.4 Remuneration

2.4.1 Our services are currently provided on a commission basis. We receive commissions from insurers when you take out an insurance policy through us. The commission is paid by the insurer and is not an additional fee charged to you.

2.4.2 Full details of commissions and remuneration applicable to your circumstances will be disclosed in our Financial Services Guide (FSG) and, where applicable, prior to you entering into any insurance arrangement.

2.4.3 In future, we may introduce fees for services such as claims management assistance or general insurance broking services. Any fees will be clearly disclosed to you before you engage those services.

3. Data Collection, Consent and Your Rights

3.1 Data We Collect From You

3.1.1 When you use our Website, submit an enquiry form, or otherwise interact with us, we may collect your full name, mobile phone number, email address, date of birth, state or suburb, occupation, income, insurance needs, preferred contact times, referral source, and other information you choose to provide.

3.1.2 Where required for insurance applications or assessment, we may collect sensitive information, including health, medical and lifestyle information. The collection of sensitive information is handled in accordance with our Privacy Policy and applicable privacy laws.

3.1.3 We may collect your information through our Website enquiry forms, telephone calls, video meetings, email, in-person meetings, or through Referral Partners who refer you to us.

3.2 Your Consent to Contact - IMPORTANT

By submitting your contact details through our Website or any enquiry form, you consent to Protect Buddy contacting you about your insurance needs using the contact details you provide.

3.2.1 By providing your mobile number and/or email address through our Website or a Referral Partner, you consent to receiving telephone calls, emails, and other communications from Protect Buddy about our services and your enquiry.

3.2.2 Your consent to contact is specific to the channel through which you provide consent. Providing an email address does not automatically constitute consent to receive SMS, and vice versa. We will comply with all applicable consent requirements.

3.2.3 We will only contact you during lawful hours as required by the Telecommunications (Telemarketing and Research Calls) Industry Standard 2017.

3.2.4 Prior to making outbound calls to leads or prospects, we check all phone numbers against the Do Not Call Register managed by the Australian Communications and Media Authority, unless an exemption or consent applies.

3.3 Your Right to Withdraw Consent and Opt Out

3.3.1 You may withdraw your consent to be contacted at any time. To opt out of telephone calls, contact us at 02 7247 2050 or email insure@protectbuddy.com.au. To opt out of email marketing, use the unsubscribe link or contact us directly.

3.3.2 We will action all unsubscribe and opt-out requests within 5 business days or earlier where required by law. We will not contact you after processing your opt-out request except where required or permitted by law.

3.3.3 Once you have opted out of a particular contact channel, we will not resume contacting you through that channel unless you provide fresh express consent.

3.4 Do Not Call Register Compliance

3.4.1 We are committed to full compliance with the Do Not Call Register Act 2006 (Cth) and the Telecommunications (Telemarketing and Research Calls) Industry Standard 2017.

3.4.2 Before making telemarketing or outbound calls to any telephone number, we check that number against the DNCR. We will not call any number listed on the DNCR unless the individual has given express consent or another exemption applies.

3.4.3 Non-compliance with the DNCR laws can result in significant penalties for businesses. We take this obligation seriously and maintain compliance records accordingly.

3.5 Spam Act Compliance

3.5.1 We are committed to full compliance with the Spam Act 2003 (Cth) and the Spam Regulations 2021 (Cth).

3.5.2 We will only send commercial electronic messages, including email and SMS, where we have your express or inferred consent and the message complies with applicable law.

3.5.3 Every commercial electronic message we send will clearly identify Protect Buddy, include accurate sender contact details, and provide a functional unsubscribe facility.

3.5.4 We do not use address-harvesting software or purchase marketing lists produced using such software. This is prohibited under the Spam Act 2003 (Cth).

3.5.5 We maintain records of all consents obtained, including the method, date, time, and source of consent, where required by ACMA.

3.6 ASIC Lead Generation Compliance

3.6.1 ASIC has oversight of lead generation activities involving financial services. We conduct our lead generation activities in compliance with all applicable ASIC requirements and guidance, including that we do not use misleading or deceptive tactics to obtain leads, and do not use high-pressure sales practices.

3.6.2 We note that ASIC has commenced a review of financial advice businesses and telemarketing super switching models. We are committed to full transparency in our lead generation, referral, and client acquisition practices.

3.7 Privacy Policy

3.7.1 The collection, use, storage, and disclosure of your personal information is governed by our Privacy Policy, available on our Website at www.protectbuddy.com.au and forming part of these Terms.

3.7.2 By accepting these Terms, you also acknowledge and accept our Privacy Policy.

3.7.3 Our Privacy Policy explains how we handle both personal information and sensitive information, including health and medical information, your rights of access and correction, and how to make a privacy complaint.

4. General Advice Warning and Disclaimers

4.1 General Advice Only

4.1.1 All information, guidance and communications provided by Protect Buddy are general advice only. General advice is defined under the Corporations Act 2001 (Cth) as financial product advice that does not take into account your objectives, financial situation or needs.

4.1.2 Before acting on any general advice we provide, you should consider whether it is appropriate having regard to your personal circumstances. We strongly recommend you obtain a copy of the relevant Product Disclosure Statement and Target Market Determination before making any decision.

4.1.3 We are authorised to provide general advice on life insurance products including life, TPD, trauma insurance, and income protection insurance. We are not authorised to advise on products outside our authorisation.

4.2 Accuracy of Information

4.2.1 While we take reasonable care to ensure information on our Website and in our communications is accurate and up to date, we do not warrant that it is complete, accurate, or current. Insurance products and insurer requirements may change without notice.

4.2.2 Nothing on our Website constitutes an offer to provide insurance. Any insurance cover is subject to underwriting, insurer approval, and the terms and conditions of the relevant insurer's Product Disclosure Statement.

4.3 Referral Partner Information

4.3.1 Where you are referred to us by a Referral Partner, we take no responsibility for statements made by that Referral Partner about our services. Our services are as described in these Terms only.

5. Client Obligations

5.1 Accuracy of Information You Provide

5.1.1 You must provide us with accurate, complete and up-to-date information when engaging with our services, particularly in relation to insurance applications, where non-disclosure or misrepresentation may affect your ability to obtain or claim under insurance.

5.1.2 If any information you provide to us changes, you must notify us promptly so we can update our records and help ensure your insurance cover remains appropriate.

5.1.3 We accept no responsibility for any loss or damage arising from your failure to provide accurate or complete information.

5.2 Lawful Use of Our Website

5.2.1 You must only use our Website for lawful purposes. You must not use our Website in any way that violates any applicable Australian law, interferes with the Website, introduces malicious code, attempts unauthorised access, or misrepresents your identity.

7.2 Nothing in these Terms excludes, restricts or modifies any right or remedy, guarantee, warranty, condition, implied or imposed by legislation, including the Australian Consumer Law, which cannot lawfully be excluded.

7.3 Where our liability cannot be excluded, it is limited to the greatest extent permitted by law and, where applicable, the resupply of the relevant service.

7.4 Our Licensee, Nexa Life Solutions Pty Ltd, maintains professional indemnity insurance covering authorised activities carried out under its AFSL. Details are available upon request.

10. General Provisions

10.1 These Terms, together with our Privacy Policy, constitute the entire agreement between you and Protect Buddy in relation to your use of our Website and services.

10.2 If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.

10.3 Our failure to enforce any provision of these Terms does not constitute a waiver of our rights.

10.4 These Terms are governed by the laws of New South Wales, Australia. Any dispute arising from these Terms will be subject to the non-exclusive jurisdiction of the courts of New South Wales and the courts of appeal from them.
